Rand Paul introduces bill to end no-knock warrants
The Hill ^ | 06/11/2020 | Jordain Carney

Posted on 06/11/2020 9:09:27 PM PDT by BenLurkin

Paul's legislation, titled the Justice for Breonna Taylor Act, would prohibit federal law enforcement from carrying out a warrant "until after the officer provides notice of his or her authority and purpose."

It would also apply to state and local law enforcement that receive funding from the Justice Department.

A proposal unveiled by House and Senate Democrats earlier this week would ban the use of no-knock warrants in federal drug cases and tie law enforcement funding to state and local agencies on a similar ban.

I would imagine in some cases a no knock would be prudent. Maybe they should use a bullhorn and tell them to come out with your hands up or we’re coming in.

Probably a good idea. Give these cities a dose of their ‘no police’ reforms for awhile.

Many innocent people have been murdered by bogus no-knock warrant executions. Not just one here and there, but many, and often. They were always a bad idea.

I support this bill. Been a number of completely innocent people killed (and/or their pets) because they had the wrong address. If they have the resources to do a raid, they have the resources to surround a building and wait it out.

“David Koresh! Come out with your hands up!”

Or they could have picked him up on one of his daily jogs or at the grocery store...

Nope...They decided to have a barbecue instead...

One of the biggest problems with no-knock warrants is that the occupant doesn’t know who is crashing thru his front door. Home invaders? Someone high on meth? So the occupant tries to defend himself (a reasonable behavior). And then someone gets shot who didn’t need to get shot.

That’s why your idea is a good one. It makes it clear that the police are outside. I always thought the cops should have to turn on their cruiser lights and sirens the instant before they hit the door. Let folks know it’s the cops.

No-knock warrants are both unAmerican and fascist.

No-knock warrants are a recipe for disaster. Anyone sitting in their home that gets surprised by armed assailants busting down the door armed to the teeth is going to be operating on instinct and not reasoned logic. While some people freeze when attacked there are people have a very fast fight-back response that they have either by nature or nurture and their first response will be to attack any invader.

No knock raids have to be approved by a judge based on evidence. If you could trust judges, there would not be a problem. But then, our system was meant for a moral American people. Apparently there are a bunch of judges appointed by clinton/bush/obumber that lack that fundamental American trait.

I don’t get “no knock warrants”.

They seem like a sure way to get a bunch of cops killed.

If someone comes in to my home yelling “police, warrant”, I will assume they are criminals feigning cops. Any other reaction would be absurd.

How many innocent people have died because the police had the wrong address?

If someone is smashing in your door, is your first thought, 'that must be the police'?

^This. It’s not like he, or the others, stayed holed up in that compound year round. They all came and went every day. They could have got them any time they wanted away from home, one at a time.

>>I don’t get “no knock warrants”.<<

My understanding it started with drug warrants, so they couldn’t destroy the evidence. So how the hell was Duncan Lemp going to destroy his guns if they showed up during the day with a normal warrant and knocked on the door?

No knock warrants AND civil asset seizure needs to end.
