I wrote this on another thread, but would like cboldt’s take:

From listening to the Judges’ comments, I’d say they will send the case back to Judge Sullivan so he can hold his “hearing”, which then allows him to either dismiss or not. Appeal Court Judges said, “if he does not dismiss at that point, come back and see us then. But Mandamus is not warranted.” At least, that’s my takeaway. I’m not an attorney but was raised by a damn good one!

That was my takeaway also...but you never know for sure solely from oral arguments/questions. I’m also not an attorney. Tried to stay in a Holiday Inn Express recently but it was closed due to the Coronavirus.

I agree that is most likely. Toss it back to Sullivan, who, in the DC Circuit's point of view hasn't yet misbehaved.

If the public had a clue what hacks these judges are, there would be a stronger outcry that we get now. We're pretty much a banana republic, and the judges are a big part of that.
