The federal judge overseeing Michael Flynns criminal prosecution has directed the law firm that Flynn fired to reappear as an interested party in the controversial proceeding. On Thursday, that firm complied by filing a notice of appearance.
U.S. District Judge Emmet Sullivan of the District of Columbia on Thursday ordered the clerk of the court to add Covington & Burling LLP (Covington) as an interested party in this matter and directed counsel for Covington to file a notice of appearance on behalf of Covington as an interested party. John E. Hall, the chair of Covington Burlings global litigation practice, submitted the filing.
The order follows the highly controversial decision by the DOJ last week to file a motion to drop the criminal charges against Flynn, despite the retired lieutenant general having already pleaded guilty to lying to agents from the Federal Bureau of Investigation (FBI). The DOJ now believes the Flynn case was an inappropriate setup.
Flynn was initially represented by Covington & Burling and attorneys Robert Kelner and Stephen Anthony when he pleaded guilty to charges that he lied to the FBI. However, he fired his legal team soon thereafter and replaced it with a new of team of attorneys led by conservative lawyer Sidney Powell. The new attorneys immediately accused Flynns previous legal team of ineffective assistance of counsel.
Mr. Flynns guilty plea (and later failure to withdraw it) was the result of the ineffective assistance of counsel provided by his former lawyers, who were in the grip of intractable conflicts of interest, and severely prejudiced him, Flynns current legal team wrote in a January motion to withdraw his guilty plea.
That pernicious conflict infected and prejudiced his defense until he retained new counsel in 2019.

That would be consistent with Obama’s no doubt highly intentional “mistake” in the Isikoff transcript where he said Flynn had committed perjury.
Sigh. We all sit and watch this nonsense happen unabated.
Flynn is under a gag order while the trial is ongoing. They do NOT want him talking.
It does matter. This is the absolute nadir in the history of America's judicial system. This has now evolved beyond a malicious prosecution and judicial overreach. This is throwing things at the wall to see what stick PERsecution.
If there WERE justice in America, then Sullivan would be disbarred, impeached, and sued so hard they'd confiscate his gold fillings.

That’s the funny thing, there is no prosecution and more. The DOJ has dropped all charges...
This is all preposterous. Judge Sullivan is going to prove Flynn was guilty, damn it!
But the issue before him is DOJ dropping the case, it’s not perjury, ineffective counsel, contempt of court.
If these former attorneys now appear and act contrary to Flynn’s interests, that’s improper.
I’ll take a shot at this one: the judge wants to be able to examine Covington’s lawyers under oath to try to refute General Flynn’s claims of ineffective assistance of counsel which were made by Sidney Powell in her motion to repudiate the guilty plea. That’s why he’s made them a party. A clever way to get around General Flynn’s right to client-attorney confidentiality.
He wants to build a record that Covington was not ineffective so that he has a fig leaf to cover his denial of Ms. Powell’s motion.
The Judge is wanting to persecute this man one more time.
If I was DOJ, I would request that the DOJ be removed from the charging documents and replaced with the Judicial Branch.
This is Deep State protecting itself above all else. Sullivan is like a Bush family member - Deep State when push comes to shove.

if recanting a guilty plea they need to prosecute a whole lot of people or its disparate treatment or he is going to find old lawyers in contempt for something...lol

Sydney Powell needs to appeal this NOW a higher court needs to smack this Robed dictator up side the head!! I honestly think this judge is a French fry short of a happy meal, he is no longer working with a full deck!!
The Judge is not going to go after them.
That law firm will be there to tell the judge
they did not tell Flynn to plead guilty.
Makes me wonder whom is giving him orders and why. He’s clearly showing a bias so recusal should be required.
This is quite astonishing really. It looks awful. It’s one thing to be an activist judge about an oil pipeline and alike, it’s another when you’re trying to take somebody’s liberty away. Somebody should pay this man a ‘visit’.

There are reasons people have to fire their legal counsel from time to time.
Lawyers work “deals” and sometimes that mean screwing some clients to get favor in other cases.
But never trust a lawyer, not even your own.
