FWIW, in a session yesterday with Mark Levin, LG was careful to distinguish the political work of the Senate from the criminal work of the DOJ. Politically, he said, there's no way that the Senate could go after Obama, but if they discover anything incriminating in the Senate investigations, they will certainly hand it over to DOJ.
Well he’s right. The Senate (or House) has oversight responsibilit. That means they can investigate but they’re not law enforcement. If they find what seems to be evidence of wrongdoing their job is to refer it to the Dep’t of Justice.
