My wife, who is also a retired attorney, pointed out that I was conflating "as-applied" constitutional challenges to CV19 orders, and judicial rulings on those, with "facial" constitutional challenges to CV19 orders. Plus there is a big difference between enforcement of CV19 orders by suspension of a business license versus enforcement through the criminal justice system. So the subject is way more complicated than I put it.

This is in addition to your points.

Basically state governors have a lot of room in dealing with epidemics through their own orders, but there are also a lot of ways they and their underlings can exceed that emergency authority. Many governors are doing both, which makes things confusing. And makes flat statements like mine pretty silly.

We can agree on that most definitely! I also agree reality gets complicated. We're going to hopefully get a break for 4 or 5 months - and our state legislatures better be acting quickly to make sure that the wrongs evidenced in the past month aren't repeated come winter. Happy Cinco De Mayo to you and your lovely wife. For the first time ever, there's no parties going on down the hill. Kind of weird.
