I’m so far behind the last few days I sense if I ask my question it will already be answered but, on this Posse comitatus:

Xone: “As regards the military use in law enforcement, I don’t think it changes anything. But, I’m not a JAG and hate lawyers especially when I don’t need one.”

Grimmy addressed this too in a previous post and LJ keeps asking a lot of my questions.

My one of big questions is, if reserves are called into action isn’t it possible this is to prepare for attacks from NATO or other DS govts *claiming* to keep peace or prevent a coup in the US?

Am I being too much of an alarmist? Seeing boogie men beyond the trees? I’m just thinking perhaps its a move of wise preparation, or perhaps a move to discourage any enemy DS force from thinkin’ about this. Y’all got opinions on this?

And for that purpose AD military in the US is not posse comitatus as I understand it.

Pretty sure you’re right, besides Posse Comitatus is waived in cases of insurrection.

I really do not know the answer to your question. All I know is in a nationarl emgergency, president powers are very much expanded. As VP Pence said, presidential powers in a national emergency are “Plenary”, it was the same news briefing in which Trump also said he had much more power than he is using, that he could use.

Yes, I think you are seeing boogie men as NATO or the UN or any nation has zero chance of getting here or remaining living if they did. I think that the activation which will likely take 10-14 days for the called units to be Fully Mission Capable. Unless there is 'another step', Title 10 (active duty) forces are not allowed to do law enforcement within the US due to Posse Comitatus and the statutory restrictions that currently are in place. They can and do support LE, but only Title 32 (NG) have arrest powers within their own states at the direction of the Governor or an adjacent state at its Governor's direction.

If the NG is 'federalized', they are in effect Title 10 and become AD with the same restrictions.
