Unfortunately, 'enemy combatant' lacks precision as you can be an 'enemy combatant' and be immune from prosecution/retribution because you are lawfully fighting.

Unlawful combatants are just that, have zero mandatory protections, can be killed on the battlefield, if captured (why?) prosecuted. They have the international status equivalent to a brigand or a pirate.
