This is a common misunderstanding
The Federalist Papers are the work of three men - Hamilton, Madison, and Jay
They do not trump the plain meaning of the text of the Constitution
“High crimes and misdemeanors” means what it says, there must be a crime

This whole argument rests on the question of what is the definition of high crimes and misdemeanors
If you read the relevant federalist paper (think its 65) it is crystal clear that impeachment doesnt need a statutory crime.
So if thats the best argument...thats so week

"Crime" means "crime"
"Misdemeanor" means "misdemeanor"
The Constitution does not permit impeachment for non-crimes
