This is a common misunderstanding

The Federalist Papers are the work of three men - Hamilton, Madison, and Jay

They do not trump the plain meaning of the text of the Constitution

“High crimes and misdemeanors” means what it says, there must be a crime

This whole argument rests on the question of what is the definition of “high crimes and misdemeanors”

If you read the relevant federalist paper (think it’s 65) it is crystal clear that impeachment doesn’t need a statutory crime.

So if that’s the best argument...that’s so week

"Crime" means "crime"

"Misdemeanor" means "misdemeanor"

The Constitution does not permit impeachment for non-crimes
