What would give them they idea that all new territory would have slavery when the founding fathers outlawed slavery in the northwest territory? Taney struck that restriction down as part of his Dred Scott decision.

Taney struck that restriction down as part of his Dred Scott decision. And I can see his argument as to why, though Taney went way further than can be supported by a reasonable interpretation of Constitutional intent.
