Fair enough, but I believe there is a strong argument that Article 2 Section 4 has not been met.

Perhaps, but functionally it is over. They have the bloody shirt of 'impeachment' to wave when the SCOTUS vacancy occurs. There are plenty who think the President has to move out of the WH based on that vote. Civics ignorance.

Article 2 Section 2 Clause 1
President has Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.

Does this mean that Trump cannot pardon Flynn?

And when President Trump nominates a new Supreme Court Justice, they will claim he can’t. If approved by the Senate, they will scream “Illegitimate”.

It’s all political theatre, to confuse the American voter, and bring about the destruction of our Republic.

Look, I can write a check for my electric bill. I can have people witness the check writing. I can memorialize it in my diary. But if I don’t mail the check, I haven’t paid the bill.

Rarely, do Presidents have control of both houses of congress during their presidency. If they were to try this, then EVERY president going forward will end up a lame duck President.

For that reason, I don’t think it will work.
