That means it is legally possible, in the case that RBG passes, for Trump to put in a conservative recess appointment in the last year of his term while under impeachment proceedings. Wow, that would make for a contentious situation.

The catch is that the Senate would actually have to recess and not use pro forma sessions when they leave town. It may have been decades since the last official recess that was more than just a few minutes.
