Murder 1? Murder 2? I think if its unintentional murder, ie negligent homicide, then yes. Wouldnt say she had intentional plans to murder him beforehand.

But yes, negligent homicide.

Texas doesn’t have 2nd degree murder. If you intend to kill someone and it is not legally justifiable - ie, self-defense - then it is murder. If you murder while committing a crime, it is “capital murder”, which is more severe than “murder”. She has been convicted of the lesser murder charge. She WAS trying to severely injure or kill the man and had no valid reason for doing so. In Texas law, that is “murder”.

Not a lawyer. That comes from reading some lawyers websites about murder in Texas.
