Ex Parte Quirin is the 1942 case of the eight German saboteurs who were tried by a military tribunal even though they were not in military uniform when captured.

They were tried and sentenced to death, and the Supreme Court validated the method of trial and verdict.

This is what Graham questioned Kavanaugh about during his confirmation hearing.
