My thought on this is that military officers swear to uphold the constitution, they (unlike enlisted) do not swear to follow orders of the CinC.

Everyone that serves in the U.S. military, regardless of rank, take an oath to uphold and defend the Constitution of the United States against all enemies foreign and domestic so help us God.
This is for anyone that enters the Service as an Officer or Enlisted.
