For Acting position, no. He just does it. His picks are limited by law to those already confirmed by the president, or those in the same org at or above a certain level.

The confirmation process has three steps.

• nominate - president can do this any time he wants
• confirm - Senate has to be in session
• appoint - president has the ability to REJECT a noiminee even after confirmation. Obtaining the ofice requires appointment. The president usually does this withing hours or days of confirmation, but he does not need the Senate in session to execut the appointment
