The hoped-for avenue of collection/enforcement is against non-Cuban companies that are benefiting from the expropriated assets. For example, one of the cases, Carnival Cruises is a defendant because it’s now using Cuban ports and docks stolen from the plaintiffs. Similar situation with European companies doing business in Cuba. If you can establish that, say, a German company is now using or benefiting from the stolen asset, you can target that German company. Maybe you can’t enforce a judgment in Cuba but you can enforce it against the German company’s U.S. operations.

An adjustment of claims against Cuba for confiscated property has to happen before relations and trade is normalized, and, ironically, this may be one step in that direction.
