>>>Premeditated murder. Plain and simple.

Yet to be determined. Perhaps he got the gun to defend himself. Perhaps the man threatened him or punched him and fearing for his life he stood his ground and shot him.

Doesn’t matter. He had the ability to walk away, outside, and call the cops, if what you said happened. This is so far from Stand Your Ground, it couldn’t be any farther. The perp went outside and came back in.

” At one point, Hicks left the Waffle House and retrieved a 9mm Glock pistol, which was later recovered at the scene, according to the sheriff’s office.”

Once he disengaged there was no threat. He chose to return, armed, to renew the confrontation.

He did NOT "stand his ground." He went to his car which was in the parking lot, not right there beside his table, and got his gun out then returned into the WH and shot the guy who dissed him. One has no necessity to retreat but things change when one "retreats" and returns then to the fray.
That said, Gainesville is a special case within Florida, There seems to be more government there than anywhere else in the state including Tallahassee. Every federal and state agency has offices in Gville and abortion clinics at least used to abound. There is UF and a very large CC now 4 year college with the most insane psychology departments, both of them, in America. Those psychs seem to turn up everywhere in local situations and I have seem them ruin lives by malicious diagnosis and treatment of impressionable and previously sane but conflicted students and citizens.<
I lived there thirty+ years ago and have visited from time to time since. After being away for a while I used to get to thinking that it would be nice to live in Gainesille for the climate and surroundings. Then My wife and I visit down there for a couple of days and re-understand in just a few hours why it is we would never ever live there.
