The shots fired against Scalise were (supposedly) fired by a lone crazed gunman. There was no attempt at a violent takeover of the federal government.

When LEOs, federalized national guard or US military personnel execute a mission on US soil under US law, anyone who resists is in a state of insurrection.

I suggest a quick bit of research into the Insurrection Act of 1807.
