That practice effectively allowed a deceased judge to exercise the judicial power of the United States after his death. But federal judges are appointed for life, not for eternity."

The grants of certiori are limited. (most of the list were denied)

could this be an attempt to void any en banc decision that was filed after Judge Scalia’s death?

(I have no legal knowledge..but I look for derpishness in everything now...)
