According to LOAC, there are Lawful, Unlawful combatants and Non-combatants. There is a third category but it is only to sort the person into one of the three above.

If International Law hasn't given you a pass, you need a recognized gov't's sanction to participate in war lawfully. Lawful combatants 'may' commit crimes for which they may be tried. Unlawful combatants 'are' committing a crime whether they live or not.
