I'm sure 'many' rogue/rouge intelligence assets get greased without the benefit of a trial, something that should be confined to overseas activities. Douchebags like Brennan will get a trial since he is a citizen, but foreign 'playas' not so much.
Unless you have a gov't sanction or an in because of international law, it is illegal (IAW LOAC) to be engaged in war. As a result, as unlawful combatants, 'They may be killed or wounded and, if captured, may be tried as war criminals for their LOAC violations.'
