Brian Cates had a good little thread about RBG that I read yesterday. I think. I don’t have time to bring it here but the basic message was that Trump and his admin know that she is failing and nothing will be said until she actually succumbs. When she succumbs, it will be made public. So, BC opines, we should cool our jets. :-)
And that Trump will be picking a third justice in due course of time.
To me, the fact that she has not been seen nor heard in what, about six weeks? - means that she is not doing well, and will continue to not do well, until she departs this world.
Justice Brennan and Justice Marshall remained on the USSC for two years after everyone involved knew they should have resigned. That was as recently as the ‘90s, and there are plenty more worse historical examples.
There are many cases of justices being absent for long periods due to health, and for holding onto the seat long after everyone knew they should quit.
Ruthie has only been out a few months, and seems to be participating. Not yet a crisis at all by past Supreme Court standards.
