I wonder if Pres. Obama’s people knew this ? Or did they just ignore non friendly rulings without knowing this ?

As I see it, POTUS declaring National Emergency is NO-LOSE for us.

First, POTUS will draft it with great specificity to avoid letting a future RAT President declare national emergency for global warming or hate speech or cooties.

Then it will be challenged and we either:

1) WIN--Getting the full wall ASAP; or,

2) "LOSE"--Permanently branding the RATS as anti-Border; AND, at the same time, setting precedent against future abuse of the power by RAT presidents.

FWIW, the National Emergencies Act of 1976 as amended specifically delegates certain powers to the POTUS in emergencies, INCLUDING:

...authorizing and constructing military construction projects (10 U.S.C. (a) § 2808 (a), passed 1982) using any existing defense appropriations for such military constructions ($10.4 billion in FY2018[16])
