If that were true, why then do corporations settle embarrassing lawsuits quickly with an iron-clad confidentiality clause?

You’ve posed an interesting question. I went looking for an answer and the answer about whether bad publicity hurts is, it depends. The Kaepernick commercial gained Nike six billion dollars. Proctor and Gamble’s stock climbed after the insulting Gillette commercial. I found this:
