I believe you gents are talking about two different proceedings. Military Courts-martial proceedings are appealable to the USSC. Military tribunal verdicts are not reviewable by the civilian court system, but the verdict can be reviewed by a 3 judge panel.

Would the three judge panel be military? And what is the difference between a Military Courts-martial and a Military tribunal?

Courts-Martial are for members of a branch of the US military. A military Tribunal can try US mil, foreign military if accused of LOAC violations, unlawful combatants.

Could be, although Nuremburg wasn't. IMO, should be.
