A private firm called MDA Analytics LLC, run by ex-federal criminal investigators, alleges that Clinton Foundation engaged in illegal activities and may be liable for millions of dollars in delinquent taxes and penalties.
The submission cites interviews investigators conducted with Andrew Kessel, Clinton foundation CFO saying he was unable to stop Bill Clinton from commingling personal business & charitable activities inside the foundation and he knows where all the bodies are buried.
Clinton Foundation sources confirm that CFO Kessel met with MDA investigators in late 2016 and subsequently was interviewed by FBI agents in 2017. But they insist he did not implicate former President Clinton or the foundation in any illegality.
GOP-led congressional subcommittee, led by Rep. Mark Meadows (N.C.), is planning to hold a hearing next week to review the work of John Huber, the special U.S attorney named a year ago to investigate all things Clinton.
A prosecutor working for Huber called MDA Analytics last week, seeking copies of their evidence, according to sources. The firm told the prosecutor that the FBI has possessed the evidence in its Little Rock office since early 2018, the sources said. Isn't that something?
Kessel told those investigators that one of the biggest problems was Mr. Clintons commingling and use of business and donated funds and his personal expenses, according to the whistleblower submission.
There is no controlling Bill Clinton. He does whatever he wants and runs up incredible expenses with foundation funds, states a separate interview memo attached to the submission.
The memo also claims Kessel confirmed to the private investigators that private lawyers reviewed the foundations practices once in 2008 and the other in 2011 and each found widespread problems with governance, accounting and conflicts of interest.
A 2008 review written by a private lawyer named Kumiki Gibson, who was hired by the foundation to study its governance, directly flagged concerns about improper commingling of charitable and private business.
The work of the Foundation and the President are intertwined in a way that creates confusion at, and undermines the work of, the Foundation at virtually every level, Gibson wrote,
2011 review conducted by the law firm Simpson Thacher raised similar concerns about legal compliance and noted that auditors in 2009 and 2010 had found material weaknesses, such as a lack of governing board meetings and unsigned board minutes.
The report raised possibility that donors expecty favors at State or from the former presidents government connections in return for money Some interviewees reported conflicts of fundraising or donors, some had expectations of quid pro quo benefits in return for gifts
Recall that FBI agents raided the home of a recognized Department of Justice whistleblower who privately delivered documents pertaining to the Clinton Foundation and Uranium One.
The whistleblower, Dennis Nathan Cain, had turned the documents over to the DOJ inspector general and both the House and Senate Intelligence committees, according to the lawyer. The FBI rummaged through Cains home for 6 hours, even after he handed over the documents.
Sixteen agents arrived at the home of Dennis Nathan Cain, a former FBI contractor, on the morning of Nov. 19 and raided his Union Bridge, MD, home. The raid was permitted by a court order signed on Nov. 15 by federal magistrate Stephanie A. Gallagher.
IG Horowitz had instructed a top aide to personally hand-carry these documents to the House and Senate intelligence committees over the summer after he received them from Cain.
Senate Judiciary Committee Chairman Chuck Grassley asked FBI Director Christopher Wray in a Nov. 30 letterwhether the bureau was aware at the time of the raid that Mr. Cain had made what appeared to be lawful disclosures to the Inspector General?
To recapitulate, there has been an ongoing investigation into the Clinton foundation's use of its finances for over a year now. This material evidence was made available to the inspector General via a private firm comprised of ex-investigators.
Why then would the FBI raid the house of a whistleblower when all the information was handed over to the inspector General many months ago? Did they not know? Or did they know but went looking for more? On what basis did the judge approve the search?
