Bingo. They know they're as guilty as hell and are seeking self-protection.

Even so, being called to testify and repeatedly stating "My attorney has advised me not to answer based on marital privilege..." or whatever, has its own (possibly career ending) effect. Maybe a way of introducing evidence?
