“Supervisors in at least four counties have received altered forms wrongly directing the voter to return the form by 5 p.m. on Thursday, Nov. 08, 2018,” Department of State interim General Counsel Bradley McVay wrote to prosecutors. The actual deadline was Nov. 5.

The altered forms were found in Broward, Citrus, Okaloosa and Santa Rosa counties.

Under Florida law, making or using an altered form is a criminal offense. In his letter to prosecutors, McVay argued that the incorrect information on the affidavits amounted to an unlawful obstacle to voting.

“Altering a form in a manner that provides the incorrect date for a voter to cure a defect (or an incorrect method as it relates to provisional ballots) imposes a burden on the voter significant enough to frustrate the voter’s ability to vote,” he wrote.

While the Senate race has emerged as the closest-watched contest in Florida, election officials are also recounting results of the state’s races for governor and agriculture commissioner.

Susan Gill, supervisor of elections in Citrus County, wrote she called a number received by a voter who had gotten an altered form, and it was the Florida Democratic Party. She questioned whether the party had mixed up a deadline for mail-in ballots with one for provisional ballots, adding the “bigger problem” was they had changed the form.

Caroline Rowland, a spokeswoman for the Florida Democratic Party, did not return a phone message and email left Wednesday by the South Florida Sun Sentinel

In a letter dated Friday, Bradley McVay, interim general counsel for the Florida Department of State, requested federal prosecutors in southern, middle and northern Florida “take all necessary steps to investigate and remedy such abuse.”

Sarah J. Schall, a spokeswoman for the U.S. Department of Justice, declined to comment about the letter.
