...Correct me if I’m wrong but wouldn’t that be an abuse of discretion standard on appeal, especially if there is dual jurisdiction?

Pardon my ignorance (sadly, all of my graduate level work was in Engineering fields) but would you mind restating that in Standard English?

My concern is that even if a judge allowed jurisdiction it would be overturned on appeal. There are two appeal standards abuse of discretion and clearly erroneous. The former is much more difficult to overturn
