Any current examples of successful prosecutions of civilians for similar charges? I don’t understand how this cross over to a military justice format works. Sorry for being dense.

You aren’t dense. Those were of us who hold our citizenship to heart have a difficult time understanding that you can forfeit all your constitutional protections when you betray your country and constitution to the degree that you become an enemy combatant.

When this occurs, you move from trial to tribunal.

No, no current examples of civilian prosecution in military courts. The last successful prosecutions were during the civil war.

“The U.S. Supreme Court agreed, and unanimously ruled that military tribunals used to try civilians in any jurisdiction where the civil courts were functioning were unconstitutional, with its decision in Ex parte Milligan (1866).”

So, after Milligan, as long as the civil courts were available, civilians have not been tried in military courts. During WWII, some Germans were tried...but they were classified as enemy combatants.

All the Gitmo folks are being treated as enemy combatants.

I know in Q-ville we don’t diss the military. However, we must keep our minds open to the fact that there may have been some military dudes involved in Obambi’s machinations. But i doubt it.
