I don’t think it is all that likely either. It was just one of the theories being floated. Some of the others related to non-disclosure agreements and such. Had to make sure he was deemed Trump’s appointee vs Obama’s. Can’t remember what the consensus was and Ianal so I have no idea which theory has the most merit. Just my recollection of what had been discussed.
Yeah, I thought it was just on the faint chance that if they ended up proving Obama not a lawful president then none of his appointments were legit either, so they just closed that little loophole, just in case. Didn’t cost them anything. Gives insight into their mindset tho... maybe.
