BTW - did you see Judge Ellis delayed further hearings in his Manafort case due to family medical issues while Clinton / Obama judge in NYC ruled as expected (without inquiry)

I did, and thank you for bringing it up in case I hadn't.

I expect Judge Ellis to arrive at the same ultimate conclusion, but the opinion and order is apt to contain some "food for discussion." I think he defers to DOJ, as selection of prosecutor is not a judicial function. Leave the appointment in the political realm, keep the courts out of it. Typical deference of ultimate responsibility while making plenty of noise.

The angle Trump has been pushing is a good one - conflicts of interest. It works vs. Rosenstein and Mueller too. If the DOJ doesn't follow DOJ regulations, the remedy generally falls entirely within the DOJ.

Sessions can demand Rosenstein recuse for the same reason he could recommend Comey be fired - it's an oversight function that has no effect on the underlying prosecution and investigation, simply assigns a new person to the job. SC can be removed (must be removed) for conflict of interest.
