Is what they are doing officially a crime?
Probably not in the usual way the criminal statutes are enforced, because the warnings the politicians give to offenders are generic, not aimed at specific individuals. Likewise the policies are political positions.
I think there are good arguments that the policy positions are criminal. Not as much of a stretch of the law as Weissman and Mueller make on a regular basis.
Better to resolve by the political process than courts though. Throw the bums out.
