Exclusive — Jeff Sessions: We Will Defeat California’s ‘Sanctuary State’ Laws

SACRAMENTO, California — Attorney Jeff Sessions told Breitbart News in an exclusive interview on Wednesday morning that he expects to prevail in a lawsuit filed by the Department of Justice Tuesday evening against California’s “sanctuary state” laws. In his first interview since the DOJ filed the lawsuit, which challenges the constitutionality of the California statutes under the Supremacy Clause, Sessions told Breitbart News that he was optimistic about the case’s prospects.

“We believe that we cannot accept the kind of restrictions that California placed on federal law officers, and we believe that their actions exceeded the Constitution, and we will win in the courts eventually,” he said.

The state’s elected leaders — all Democrats — slammed Sessions’s lawsuit on Tuesday evening. Governor Jerry Brown, Sen. Kamala Harris (D-CA), and Attorney General Xavier Becerra all took to Twitter to oppose the lawsuit. Becerra even claimed that he was determined to “uphold the law” — state “sanctuary” law, as opposed to federal immigration law.

Yep - now folks are pissed that Sessions is going to go the legal route instead of turning government guns on the Kalifornians - they fail to understand that winning this lawsuit would pretty much shut down all the sanctuary cities - with prejudice....


Why do you say that? These cities are ignoring federal law right now. They will ignore a court and no judge will go nuclear on them. Not on this issue.

The people who hate Jeff Sessions seem to believe that the US Attorney General can just issue binding edicts by decree. They don't seem to understand that the US President and his AG are not King Henry VIII and Lord Chancellor Cromwell. We have courts and due process which will stalemate any effort to put an end to sanctuary cities and other pro-illegal immigrant policies if they aren't undone within the strictures of our legal system. AG Sessions is trying to do just that and make it binding.

Sleepy has the federal law on his side. .Enforce the damn laws and let California sue him. Just like his fellow letter writing wussies in Congress he is leading from behind.


Better yet just tell the sanctuary cities that federal immigration law is not a buffet and refuse all their detainer requests for the worst of the worst.

Then these cities/states will be faced with releasing murderers and child rapists into their streets instead of turning them over to ICE for deportation.

Yep - I have no idea what they think he should do instead - maybe remind us what happens when the Feds decide to do a Ruby Ridge/Waco/Bundy type deal.....ironic since they howl that the three I mention were murder by Federal Government....I guess that what they like makes it OK to spill a LOT of blood and lose the WH and both Houses of Congress for longer than we have....

§1373. Communication between government agencies and the Immigration and Naturalization Service
(a) In general

Notwithstanding any other provision of Federal, State, or local law, a Federal, State, or local government entity or official may not prohibit, or in any way restrict, any government entity or official from sending to, or receiving from, the Immigration and Naturalization Service information regarding the citizenship or immigration status, lawful or unlawful, of any individual.

(b) Additional authority of government entities

Notwithstanding any other provision of Federal, State, or local law, no person or agency may prohibit, or in any way restrict, a Federal, State, or local government entity from doing any of the following with respect to information regarding the immigration status, lawful or unlawful, of any individual:

(1) Sending such information to, or requesting or receiving such information from, the Immigration and Naturalization Service.

(2) Maintaining such information.

(3) Exchanging such information with any other Federal, State, or local government entity.

Liberals can’t have it both ways. You can’t argue that in some cases, federal law and oversight of an issue is the prevailing legal standard, but in other cases, liberals will make their own laws at the state and local level in contradiction of federal law. They can’t have it both ways.

Not to worry, y’all will have probably passed on before this finishes winding its way through the courts, taking billions of dollars out of our pockets (one way or another). We can understand how lawyers love this sort of stuff. Other folks, not so much.

Exactly! Whole election cycles will pass before it makes it makes its way through to an eventual Supreme Court decision which will see sanctuary cities win by a narrow 5-4 margin....surprisingly a “conservative” swing vote will give it the narrow victory (similar to Roberts on the Obamacare decision).

(a) Criminal penalties
(1)(A) Any person who—

(iii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;

shall be punished as provided in subparagraph (B).
(B) A person who violates subparagraph (A) shall, for each alien in respect to whom such a violation occurs—
(i) in the case of a violation of subparagraph (A)(i) or (v)(I) or in the case of a violation of subparagraph (A)(ii), (iii), or (iv) in which the offense was done for the purpose of commercial advantage or private financial gain, be fined under title 18, imprisoned not more than 10 years, or both;

(ii) in the case of a violation of subparagraph (A)(ii), (iii), (iv), or (v)(II), be fined under title 18, imprisoned not more than 5 years, or both;

(iii) in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) during and in relation to which the person causes serious bodily injury (as defined in section 1365 of title 18) to, or places in jeopardy the life of, any person, be fined under title 18, imprisoned not more than 20 years, or both; and
