Ex post facto. Look into it.
Unless they start doing it after the implementation date their past actions don't fall under the new stuff.
I believe that only applies to the activity itself being lawful and then made unlawful. I.e. you couldn’t be prosecuted for running a bird fighting ring when it was legal but quit when a law was passed against it.
Changing the punishment doesn’t fall under it.
