the judge meant to say that the law is based on sex discrimination

I'm not sure when it began but "gender" has been substituted for "sex" for a long time so much so that it is now in the dictionary. I suspect "gender" got its start when HR departments and others reviewing applications got tired of reading "twice a week" next to "sex".

”Gender” replaced “sex” when the Marxist feminazis and postmodern perverts found that the use of the word “sex” undermined their intentions. They sought to sabotage male-female relations, and the mere mention of the word “sex” defeated their efforts. Because nobody really givens a sweet sh*t about “gender” but everyone loves “sex.” And that’s all there is to it. Really.
