This case ought to be tossed as frivolous. This guy should have to pay the Saints’ attorneys fees.

I would take this a step further. The players are bound by their contracts to their team and the league and when they decided to take a knee, violated their contract. As a ticket holder, it is my assumption that players who have contracts abide by the team’s rules and league rules. Since players egregiously the rules and the team did nothing about it, the team and league violated its contract with the ticket holders.

I wonder if, when the judge enters the court and the plaintiff were to refuse to rise, what might the judge do and how would affect the outcome?

I guess you missed where I quoted the article.
Early on it was identified that the league didn't have a rule on the subject, just a recommendation. My guess is the guy has the same odds of winning his case has the Browns have of winning the Super Bowl this season.
