It just makes me wonder if some guy somewhere, is going to decide he has had all he can take, and have a “falling down” moment?

It was a hate crime. That makes it bad. May have even been some zero tolerance mandatory sentence nonsense.

I think any crime that results in injury is a hate crime. But insulting someone should not be a crime. The only crime I see there is vandalism, breaking and entering.

Florida has detailed sentencing guidelines that limit judicial discretion in sentencing. My guess is that the bacon vandalism defendant got a heavy sentence because of a substantial score for prior offenses.

Steinle killers past not allowed in trial but it would have in sentencing as it did in bacon in mosque case

Bacon man got hammered at sentencing for the past

Had Steinle killer been convicted his past too woulda come up

The Feds weigh past history at sentencing via guidelines pretty heavy upon conviction or plea

Steinle’s killer was convicted of a couple of charges and his past record had no influence on his sentencing.

It rarely is in anyone’s

The bacon guy had his history brought up at sentencing not trial

At rape trials lawyers have tried past history like she was a whore etc

It is almost always not allowed...it’s called character evidence

Trial evidence should usually only be about that specific charge .....this notion is actually a concept of free people’s even though you understandably didn’t like that it didn’t come up but if you allow character evidence at trial then it’s a very slippery slope to exploitation by political district attorneys

Yes. That’s how it works. There is no fairness. “Hate crimes” are considered the worst crime of all. Murder by government-certified specially-privileged victim group members is treated as no crime at all.
