Is this where the idea of the ‘living document’ Constitution came into being?

But isn’t it funny how those that push this philosophy also vehemently assert civil rights that they like, including things that aren’t even written in the USC?

It's the right time period for when the "living document" doctrine came into being. But the main person responsible for it was Woodrow Wilson.
