Hate to say it but this charge might not stick.

I don’t see why not.
Intimidation.

Like the one poster said...he should have pointed it at a cop and see what may happen.

Case in VA not all that long ago where someone cut someone off and the guy that got cut off pulled up alongside the dude and SHOWED his weapon..Didn’t point it, just showed him.

Judge may have thrown it out but it sure did ruin that guys day as he got arrested for ‘intimidating’

The key is it was a fake weapon. The right lawyer will try to exploit that.

Intimidation in this example would be considered Brandishing, and the weapon does not have to be pointed at an individual to be considered Brandishing and Brandishing is a criminal offense in Texas.
