Exactly. If we don’t have an executive subject to the rule of law, we don’t have anything. I used to tell lefties that if you would be worried about a republican president having this power, you don’t want obama to have it. Now, I tell people that if you didn’t want Obama having this power, you shouldn’t give it to Trump. A vision of the executive power that relies on only the good guys ever taking office is a recipe for disaster.
These are temporary stays, and courts are mostly encouraged to issue them because there is so much uncertainty about what is going on. As the administration clarifies exactly what’s going on and people aren’t left in limbo in airports, the rationale for a stay dissipates.
Much better to let the legal process work (and keep appointing judges) than to declare the executive branch only has to obey the judicial branch when it feels like it.
