Sorry the EO has already been declared lawful by the DOJ. And you are right that the US Code gives the President, not Judges, authority over immigration. His ruling is moot. It is to be ignored by the Executive Branch.

Pretty much another useless ruling. A statement 3 days ago from the Department of Homeland Security when these activist courts tried to stay Trump’s EO here.

The ruling of the judge is even more imbecilic. He wrote that travel bans to these countries discriminate against muslims. The EO does not mention religion at all, just countries. It would just as outrageous to say that it discriminates against catholics if the travel ban included Italy or Spain.

Second, the judge wrote that it violates the constitutional rights of immigrants and their families. Immigrants, are NOT residents of this country and the Constitution does not apply to them at all.

To me, this judge is make a case that he does not have good temperment nor good standing and should be removed from the bench.
