Polk County man arrested for having milk crate

AUBURNDALE, Fla. (WFLA) – A Polk County man is behind bars after a deputy spotted him with a milk crate.

On Thursday just before 10 p.m. a PSCO deputy stopped two men on bikes. The deputy noticed that Timothy Troller, of Auburndale, had a dairy crate attached to his a purple Mongoose BMX bicycle.

The dairy crate had the business name of Sunshine State Dairy Farms clearly marked on the sides of the dairy crate. Troller claimed he found the crate on the side of the road and attached it to his bike.

Yes, I see many crates that have been taken from stores along highways and roads.

The best policy would have been to take the crate and return it to the owner, not put some slob in jail for “possession”.

Help, this Deputy would have shot my granddaughter because she once found a camera on the side of the road.

I knew parts of Florida were run by assholes. Now this latest of several from that part of the state confirm it.

Glad my relatives lived in the eastern side of Florida.

And come to DC. People ride bikes all night long esp. those who work in restaurants that stay open to at least 11:00 PM or later. This sheriff would probably shoot them to.

Our country needs a complete cleanout of the commies, crooks, and stupids (including that handful of cops who screw it up for decent folk. PS: My son was a good cop. He won’t do this crap).

Slow day, eh?

Good thing he didn’t have his dog with him.

I normally support our LEO’S but this is just plain ridiculous. Didn’t they have any more serious crimes to deal with? Or were they looking for something else on him?

Yes, if the label also says “THIS BOTTLE IS THE PROPERTY OF THE COCA COLA CORPORATION. USE BY OTHER THAN REGISTERED OWNER PUNISHABLE BY LAW.”

But if it's empty, it's not being used.

The label doesn't say *possession*, it says *use*. There's a difference.

Bothered me that the police department would stop somebody riding a bicycle at 10 o’clock at night. Polk County is backward but they do not have so much crime that they need to stop people out at 10 o’clock at night. Clinton has not been elected YET.

I understand those who say this is a crime, and merits arrest.

I also understand those who say this is a foolish arrest.

I am probably somewhere in the middle. The crate was likely abandoned by someone who received the crate, so is this truly theft? Probably not. Probably not even possession of stolen property. However, the arrest seems to be a ‘justifiable’ one and a useful one since the ‘perp’ seems to be a frequent flier among law enforcement circles.

But if I am a prosecuter, I’m looking at this and shaking my head. The best I could really charge the guy with is “Possession of abandoned property”. I don’t think that’s a crime.

I dead-docket or drop the case, if I’m a DA or ADA.

Yes, probably drop the case.

Thing is, theft of crates is a real problem for dairy farms. Petty to us, cumulatively expensive to farms.

I’d expect there’s more to the arrest, and this was just the excuse to act on an idiot driver.

I agree with almost all of this, my only change would be to expect a dairy farm to charge a deposit on the crates (such that it covers the cost of replacement). Then this cost would be recovered and the price of the actual milk could be lowered. Money motivates. For those that wish to keep the crate, they paid the deposit, so they made an indirect purchase.

Please check that ladder extremely carefully before using it. There might have been a reason for someone to throw it away, and you don’t want to find out why when you’re at the top.

At work, we are required to inspect any ladder (and fill out an inspection form) before using it. Defective ladders have to be destroyed, not just tossed into a trash bin.

Thank you so much for the heads up!

My only saving grace is, I don’t do ladders. I hate heights. If I don’t have a son/neighbor to change a lightbulb...I’ll go months, until I can eventually get help. ;)

It will make a nice stand for plants, in the summer, on the porch. THX for your good advice.

That’s why I always carry, and have my lawyer with me at all times. He comes in handy when I’m at the market check-out and the cashier starts giving me a hard time cashing in a 25¢ coupon for peaNUTZ. :)
