In Massachusetts spouses can pass on property without inheritance tax. A caller to Howie Carr’s radio show was a lawyer who handled estate matters. He told Howie that under Massachusetts’s Law (going back to colonial times, before the U.S. was a country) a father may not marry his daughter and a mother her son, but consanguinity restrictions do not apply to same sex marriages. He said he had to advise widowed clients who wished to pass on their estates to their unmarried same sex children about this loophole. Just wait’ll we get polygamy.
