Only if he tries to make money off it. And since they were in a pretty public place, they have little expectation of privacy, so they would have a pretty weak claim. Better to just give the photographer his due and celebrate the beauty they shared.
Unless they have a contract with another photographer. Public place doesn’t give photographer a pass.....in fact it makes it harder
Plus, they can’t be recognized from the photo.
