Of course, had Loibl lived, prosecutors would not have needed to put on a circumstantial evidence type case, because there were many witnesses. They would have testified.

I don't understand this - why can't eyewitness testimony be used now?

Part of the Bill of Rights is the Right to face your accuser, and to question any witness against you. Since Loibl is deceased he cannot exercise these rights, or so the theory goes. Is it bunkum? In my opinion, yes, as he is deceased by his own hand, IANAL...
