Must be in the same place where rights to abortion and gay "marriage" were found.....

My thought, precisely. I don’t see anywhere in the Constitution that the president can legislate - actually make laws through executive privilege. Congress writes the law and the office of the president sees that the law is implemented, etc.

This is part of a wider problem where federal agencies just make up rules on their own which are then relentlessly enforced—IRS, BLM, HHS, etc. The Little Sisters of the Poor would not be facing crushing fines except for rules made up by Kathleen Sebelius, or if the courts still believed in the Eighth Amendment.
