Obama Admin Tells Landlords They Can’t Refuse To House Criminals

The Obama administration released a warning Monday telling the nation’s landlords that it may be discriminatory for them to refuse to rent to those with criminal records.

The Fair Housing Act doesn’t include criminals as a protected class, but the Department of Housing and Urban Development (HUD) says refusing to rent based on a criminal record is a form of racial discrimination, due to racial imbalances in the U.S. justice system.

For instance, while blacks are about 12 percent of the U.S. population, they are about 36 percent of the prison population. Hispanics are also overrepresented behind bars, though to a much smaller degree.

HUD says that landlords may be allowed to bar those with criminal records from living in a facility, but they will have to prove that such a policy is necessary for protecting the safety of other tenants, and designed to avoid illegal discrimination. The new guidance recommends that landlords consider factors such as the severity of the criminal history and how long ago it occurred.

The new guidance isn’t the first move by the Obama administration to break down perceived racial barriers in the housing market. HUD launched an effort in 2015 to encourage cities to use Section 8 and other levels to create racially-integrated neighborhoods. The effort came in the wake of a Supreme Court ruling that policies which result in unintentional housing discrimination may be targeted in lawsuits.

Since the vast majority of child molesters are male I am guilty of sexual discrimination if I do not let them rent the apartment building next to the grammar school?
Since the vast majority of serial killers are white I am a racist if I don’t let one rent the room over my garage?

My thought, precisely. I don’t see anywhere in the Constitution that the president can legislate - actually make laws through executive privilege. Congress writes the law and the office of the president sees that the law is implemented, etc.

I thought representation in the prison population was supposed to be on the basis of having committed a crime, regardless of race, creed, color, national origin, sexual orientation, relationship with the family pet, etc.

So, with that population already screened on the basis of equal opportunity, deciding you didn't want to have a sex offender move in next to your family just might be on some other basis.

Let the barbarians in the gated communities first.

You’re right. This all stems from ridiculous judicial decisions inventing the concept of “disparate impact.” The logic (really, the illogic) is that any practice, rule, or procedure that has a “disparate” (i.e, different) impact on a certain race (or any other preferred group) is presumptively invalid.

This “equality of outcome” reasoning has caused a total lessening of standards in practically all walks of life. Typical (and very easy to pass) employment tests have been banned, because blacks pass at a lower rate. IQ testing has been banned in California public schools for the same reason. Believe it or not, some states tried to insure a minimal level of competence among high school teachers by requiring them to pass a high school exit exam: Yep, the teacher’s unions sued under the “disparate impact” theory because so many black teachers couldn’t pass the (very easy) test. This latest thing requiring renting to convicted criminals is just one in a long line of outrages, but a very very dangerous one.

Blacks, hispanics, whites, and asians commit violent at different per capita rates. Just go to the FBI website for the numbers. Those groups are represented in the prison population very closely to their group crime rates. The criminal justice system actually does a very good job at treating people based on their individual circumstances, not on their race. This is true of gender also—there are about 1/10th as many women in prison as men. Guess why: Women typically don’t commit serious, prison eligible crimes at nearly the rate men do. Disparate impact on men? Well, taken to the ridiculous illogical extreme, this would be an argument to lock up only as many men as women, since laws against violent crimes obvious have a “disparate impact” on men.

This “disparate impact” nonsense is simple cultural marxism—equality of outcome enforced by the state, and to heck with fairness, standards, or even public safety.

Are there laws against fair-Issac scores? Landlords should be able to set certain requirements - 1st, last months rent and one month security deposit, are usually the current standard. Add on required 725+FICO score and a hefty cleaning deposit ... boom. If a person has to cough up $4250 cash up front min.. AND have a high(er) FICO, well 75% of the crapweasels are excluded no harm no foul.

Ten years was enough.
And you’re right: like the job-killing ‘Affordable care’ act (Hey, they named it), this will reduce the number of ‘affordable’ rentals.
