Did you see the video? Leroy actually did have his hands up.
Well he did until he got shot. Then he reached down, maybe because he had been shot.
But lowering his hands and that point apparently justified the following shots. And shooting up the truck he had exited.
But at this point, what does it matter?

Of course I saw the video. I saw a guy with his hands up reach into his pocket for his pistol and get smoked.

It shows clearly that he raised his hands - but it shows just as clearly that he then brought them down to his body before the shots were fired.
What the video doesn't make clear is if there was something near Leroy's hands that could have appeared to be a weapon. Because unlike Michael Brown, he wasn't charging the cops, nor had he previously tried grabbing (and shooting with) a cop's gun.
