This is a “party matter” (i.e. raw political power) so I doubt that the GOP leadership in the Senate will allow a vote. Now it is possible that Obama might try a recess appointment. Our guys are not exactly brilliant on the rules.

Here is where we need to make sure the next president is a true conservative and not a faux one.
